Terms and Conditions

DELIVERY (SIM CARDS): All SIM cards are dispatched by standard post from our distribution hub in Madrid, Spain unless you request an upgraded shipping option. If you request tracked/express delivery, an additional fee of €9 per SIM applies. Standard post typically takes between 7–15 working days (timeframes are estimates only and are not guaranteed). Once an item has been handed to the postal service, we cannot be held responsible for delays or SIM cards going missing in the post. If you do not receive your SIM card within the expected timeframe, please notify us straight away and we will endeavour to resolve the issue promptly — for example by cancelling the original SIM and issuing a replacement SIM, or agreeing an alternative solution.

These Terms and Conditions ("Terms") govern your use of SimFalcon services and products, including IoT SIM cards, connectivity, tracking platforms, devices, and related support ("Services").

By purchasing or using any SimFalcon Services, you agree to be bound by these Terms.

1. Legal Entity and Trading Name

SimFalcon is a trading name of Lynsco Group Ltd, a company registered in Ireland (Company No. 570133) with registered VAT number IE3387161QH ("we", "us", "our", "SimFalcon").

2. Scope of Agreement

These Terms apply to all purchases, subscriptions, and use of SimFalcon Services, whether through our website, authorised resellers, or direct contracts.

They form part of the overall Service Agreement ("Agreement") between the Customer ("you", "your") and SimFalcon.

3. Services

SimFalcon provides:

  • IoT and M2M SIM cards with multi-network connectivity
  • Tracking, monitoring, and telematics software platforms
  • Data and device management tools
  • Customer and technical support services

SimFalcon reserves the right to modify, suspend, or discontinue any Service or feature at any time, with or without notice, to maintain network integrity, comply with law, or improve performance.

4. Customer Obligations

You agree to:

  • Use the Services only for lawful purposes and in accordance with these Terms
  • Ensure that all devices connected via SimFalcon SIMs are type-approved and compliant with local regulations
  • Not use Services in ways that could damage, disable, or impair networks or systems
  • Keep login credentials confidential and notify us immediately of any unauthorised access
  • Comply with all applicable export control, data protection, and telecommunications laws

SimFalcon may restrict or suspend service if you breach these obligations or if your usage endangers network performance, security, or lawful compliance.

5. Ordering and Activation

  • Orders are subject to acceptance and availability
  • SimFalcon reserves the right to refuse service or supply where fraud, misuse, or credit risk is suspected
  • Services begin upon activation or delivery, whichever occurs first
  • Once activated, SIM cards and subscriptions are non-transferable without written consent

6. Fees, Billing, and Payment

All fees are payable in advance unless otherwise agreed in writing.

Invoices are due within the timeframe stated (default 14 days).

Failure to pay may result in:

  • Immediate suspension of Services
  • Late payment interest at 8% per annum above the ECB base rate
  • Recovery of legal and administrative costs

All fees are exclusive of VAT, which shall be added at the prevailing rate.

SimFalcon may revise prices with 30 days' notice.

7. Subscriptions and Renewals

Subscriptions renew automatically unless cancelled in writing with at least 30 days' notice before renewal.

Cancellation does not relieve you of outstanding charges up to the end of the billing period.

8. Data Usage and Fair Use Policy

SIM data usage is measured by network records.

SimFalcon applies a Fair Usage Policy to prevent abuse of unlimited or shared data plans.

If your usage exceeds normal operational levels, SimFalcon may restrict speeds, charge overage fees, or suspend access.

9. Network and Service Availability

SimFalcon uses third-party network operators to provide connectivity.

While we aim for high availability, we cannot guarantee continuous, uninterrupted, or error-free service.

We are not responsible for:

  • Network outages or interruptions beyond our control
  • Failures due to customer hardware, misuse, or third-party interference
  • Roaming restrictions or regulatory blocks in certain countries

10. Devices and Compatibility

Devices must be compatible with the network standards used by our SIM cards.

SimFalcon does not guarantee compatibility with every device or firmware version.

You are responsible for verifying device suitability before purchase.

11. Delivery and Risk

  • Delivery dates are estimates
  • Ownership of physical goods (e.g. SIMs, devices) passes upon full payment
  • Risk passes upon delivery
  • You must inspect all goods upon receipt and report any discrepancies within 7 days

12. Intellectual Property

All trademarks, software, documentation, and technology used in the Services are owned or licensed by SimFalcon or its suppliers.

No intellectual property rights are transferred to you under this Agreement.

You may not copy, modify, reverse engineer, or distribute our software or platform content.

13. Data Protection and Privacy

SimFalcon complies with the EU General Data Protection Regulation (GDPR) and applicable data privacy laws.

We collect and process data only as necessary to provide and improve our Services.

You remain the controller of any personal data transmitted through your devices.

You must ensure that any data you process complies with GDPR and relevant local laws.

14. Warranties and Disclaimers

SimFalcon warrants that Services will be provided with reasonable skill and care.

However, we do not guarantee:

  • Uninterrupted connectivity, or
  • Compatibility with all hardware or software

Except where required by law, all other warranties (express or implied) are excluded, including merchantability, fitness for purpose, and non-infringement.

15. Limitation of Liability

To the maximum extent permitted by law, SimFalcon and Lynsco Group Ltd shall not be liable for:

  • Loss of profits, revenue, data, or business opportunities
  • Indirect, consequential, or special damages
  • Loss caused by third-party operators, misuse, or unauthorised access

Our total liability in any 12-month period shall not exceed the total fees paid by you during that period.

Nothing in these Terms limits liability for death, personal injury, fraud, or statutory rights that cannot lawfully be excluded.

16. Indemnity

You agree to indemnify and hold harmless SimFalcon, Lynsco Group Ltd, and their directors, employees, and suppliers from any claim, loss, or expense arising from:

  • Misuse of Services
  • Breach of these Terms, or
  • Violation of any law or third-party rights

17. Termination

Either party may terminate the Agreement:

  • By giving 30 days' written notice; or
  • Immediately if the other party commits a material breach not remedied within 14 days of notice

SimFalcon may also terminate immediately for non-payment, fraud, misuse, or regulatory requirement.

Upon termination:

  • All fees remain payable up to the termination date
  • SIMs and accounts will be deactivated
  • You must cease use of all Services and delete any SimFalcon software

18. Force Majeure

SimFalcon shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to:

Network outages, strikes, war, natural disasters, pandemics, or government restrictions.

Obligations shall resume once such events cease.

19. Confidentiality

Both parties agree to treat all non-public information obtained through the business relationship as confidential, unless disclosure is required by law.

20. Assignment

You may not assign or transfer your rights or obligations without our prior written consent.

SimFalcon may assign or subcontract any part of its business to affiliates or service providers.

21. Entire Agreement

These Terms, together with any written proposal, invoice, or service order, constitute the entire Agreement between you and SimFalcon, superseding all previous communications or representations.

22. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Ireland.

Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.

If you are a consumer within the EU, you may also have the right to use your local EU consumer protection laws.
